  • Assistant Public Prosecutor II: Rs. 9300-34800 with a grade pay of Rs. 5400.

  • Assistant Director: Rs. 15600-39100 with a grade pay of Rs. 7200.
  • Deputy Director: Rs. 15600-39100 with a grade pay of Rs. 8200.

(v) Both the 5th and 6th Pay Commissions have recommended elevated pay scales for Prosecution Services, underscoring the urgency of addressing the existing disparities.

(vi) The representation highlights the significant number of individuals impacted by these discrepancies, including 14 Deputy Directors, 70 Assistant Directors, 190 Assistant Public Prosecutors Grade I, and 325 Assistant Public Prosecutors Grade II.

Rajasthan APO Salary rules from different years, 1998 and 2008

For the Prosecution Department, we're looking at how much people got paid according to two sets of rules from different years, 1998 and 2008:

  • An Assistant Public Prosecutor Grade II used to make between Rs. 6500 and Rs. 9000. But after 2008, they started making between Rs. 9300 and Rs. 34800, with an extra Rs. 3600 on top.
  • An Assistant Public Prosecutor Grade I’s pay went from Rs. 6500-10500 to Rs. 9300-34800 plus Rs. 4200 extra.
  • An Assistant Director's salary jumped from Rs. 9000-14400 to Rs. 15600-39100, with an additional Rs. 6000.
  • A Deputy Director went from making Rs. 10650-15850 to earning between Rs. 15600 and Rs. 39100, plus Rs. 6600 more.
  • In the Law Department, the changes were similar, affecting various legal assistant and advisor positions, each with their own specific pay ranges and increases.

Comparing this with what Central Government employees got, there's a clear pattern: whether it's a Litigation Assistant or a Joint Secretary and Legal Advisor, everyone saw changes in their pay scales according to new rules set in 2008, moving to wider pay bands and getting additional grade pay.

For the U.T. Delhi Prosecution Directorate, the pattern continues with positions like Public Prosecutor, Senior Prosecutors, and up to the Director of Prosecution all seeing updates to their pay scales, fitting into the broader adjustments seen across other departments and roles.

In short, both state and central government employees in legal and prosecution services saw significant changes in their pay structures over the years, moving to a system that offers a broader pay band and additional grade pay to reflect their roles and responsibilities.

Rajasthan APO salaries and qualifications for jobs in legal and prosecution services

The Sixth Pay Commission made recommendations regarding the salaries and qualifications for jobs in legal and prosecution services.

- Legal Assistants in the Department of Legal Affairs wanted a higher salary because they do specialized work. Their current salary was lower than what they wanted. The commission decided not to give them the highest salary they asked for because it would disrupt the salary structure. However, they agreed to increase their salary to a certain extent.

- Public Prosecutors also asked for higher salaries, arguing that they should be paid as much as doctors because they both require a law degree. The commission disagreed with comparing them to doctors but did recommend a salary increase.

The government adjusted these recommendations slightly when implementing them.

The Rajasthan Prosecution Officers Association argued that their salaries should be the same as or higher than those in the central government, especially considering their higher qualifications at the entry level.

Upon review, it was found that positions like Assistant Public Prosecutor and Legal Assistant both require a law degree for entry, but Assistant Public Prosecutors also need two years of legal practice experience.

Despite this, the salary for a third-level promotion in the Prosecution Service was lower than in the Legal Service. The committee suggested that the salary for the Deputy Director in the Prosecution Service should be increased to match the salary of a similar position in the Legal Department.

The request to match the salary of a central government position was not considered valid by the state due to different job requirements between state and central roles. The state decided to stick with its salary adjustments without making specific increases for law degree holders.
