How to File a Sexual Harassment Complaint in India (2025 Guide)

Sexual harassment is a serious violation of a person’s dignity and rights. In India, the law strongly condemns such behavior and provides victims with the right to seek justice. Filing a sexual harassment complaint is a crucial step in standing up against abuse and holding the offender accountable.

In this blog post, we’ll explain how to file a sexual harassment complaint in India, your legal rights, the process to follow at workplaces and police stations, and the support available to victims.

What is Sexual Harassment?

Sexual harassment includes any unwelcome act or behavior of a sexual nature that makes the victim feel uncomfortable, threatened, or violated. This can happen in workplaces, public places, educational institutions, or even at home.

Examples include:

  • Physical contact and advances

  • Demands or requests for sexual favors

  • Sexually colored remarks

  • Showing pornography

  • Any other unwelcome physical, verbal, or non-verbal conduct of a sexual nature

Key Law Against Sexual Harassment in India

1. POSH Act, 2013 (Workplace)

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 or POSH Act protects women from sexual harassment at the workplace.

2. Section 354A of the Indian Penal Code (General Law)

Covers sexual harassment for both men and women in any setting, not just workplace.

Where to File a Sexual Harassment Complaint?

Depending on where the incident happened, the victim can file a complaint in one of the following:

1. Internal Committee (IC) at the Workplace

Every organization with more than 10 employees must form an Internal Committee to handle complaints under the POSH Act.

2. Local Committee (LC)

If there’s no IC at the workplace or the harassment is by the employer themselves, the complaint can be filed with the Local Committee set up by the district officer.

3. Police Station

For severe offenses or in non-workplace settings, victims can file an FIR (First Information Report) under Section 354A or other relevant IPC sections.

Step-by-Step Guide to File a Complaint

A. Filing with Internal Committee (Workplace)

  1. Write a Written Complaint

    • The complaint should clearly mention the incident(s), time, place, people involved, and any evidence if available.

    • Must be submitted within 3 months of the incident.

  2. Submit to the Internal Committee

    • Submit it to the Presiding Officer or any committee member.

    • If the complainant is unable to write, help can be taken from a trusted person or committee member.

  3. Committee Action

    • The committee will conduct an internal inquiry.

    • Both the complainant and accused will be heard.

    • The inquiry must be completed within 90 days.

  4. Recommendations

    • If found guilty, disciplinary action can be recommended (e.g., termination, warning, compensation).

    • The report will be sent to the employer within 10 days.

  5. Employer Action

    • Employer must act on the report within 60 days.

B. Filing with Local Committee (if IC not available)

  1. Visit the District Collector’s Office or the District Social Welfare Office.

  2. File your complaint with the Local Complaints Committee (LCC).

  3. The process is similar to the IC inquiry.

C. Filing an FIR with Police

  1. Visit the nearest police station (can also file online in many states).

  2. Give a detailed written complaint.

  3. Mention relevant IPC sections (police will help):

    • Section 354 (Assault or criminal force on woman with intent to outrage modesty)

    • Section 354A (Sexual harassment)

    • Section 509 (Insulting modesty of a woman)

  4. Police will investigate the case and may arrest the accused if needed.

What if the Complaint is Against Your Boss?

If the accused is your boss or someone in senior management:

  • File the complaint with the Local Committee (not the IC).

  • You may also approach the National Commission for Women (NCW) or State Commission for Women.

What if You Fear Retaliation?

The POSH Act clearly prohibits:

  • Victimization of the complainant

  • Threats, demotion, or termination for filing a complaint

If retaliation happens, you can:

  • File a fresh complaint for victimization

  • Approach the Labour Commissioner or Human Rights Commission

False Complaints – What the Law Says

If a complaint is found to be intentionally false, the committee can recommend disciplinary action. However, failure to prove harassment is not the same as making a false complaint.

What Support Can a Victim Get?

  • Counseling and legal aid

  • Transfer or leave from workplace

  • Confidentiality of identity is maintained

  • Help from NGOs and support groups

Importance of Filing the Complaint

By reporting harassment:

  • You protect yourself and others.

  • You create awareness.

  • You help enforce the law and workplace ethics.

Final Thoughts

Filing a sexual harassment complaint in India is your legal right. No one should tolerate harassment in silence. Whether at the office, on the street, or anywhere else, justice is possible if the right steps are followed.

Know your rights, gather courage, and don’t hesitate to seek support. You’re not alone.
